Release and Waiver of Liability

(This Is A Contract - Read Carefully Before Signing)

This Release and Waiver of Liability (the “Release”) dated {sign_date} is entered into by and between (the “Participant/Participant Parent or Guardian”) and Elite Combative Systems, LLC, and its owners, members, managers, officers, agents, employees and assigns (the “Released Parties”).
{name} desires to participate in martial arts services, including but not limited to training, classes, and events, and to use the facilities offered by Elite Combative Systems, LLC (“My Participation”). In consideration thereof, I agree as follows:
1.     WAIVER AND RELEASE: I, the Participant/Participant Parent or Guardian, release and forever discharge the Released Parties from any and all liability to and claims by me, my personal representative, heirs, and assigns, for any and all injuries or damages of any kind arising out of or relating to My/My Childs' Participation, even if the injuries or damages are the result of the negligence or other improper conduct of any of the Released Parties or others.
2.     INDEMNIFICATION: I, the Participant/Parent or Guardian, agree to defend, indemnify, and hold harmless the Released Parties from and against any and all claims, demands, causes of action, damages, liabilities, judgments, losses, fines, awards, penalties, costs and expenses, including attorneys’ fees and other costs of defense arising out of or resulting from My/Our Child’s Participation or any injuries or damages to Me/Our Child.

3.     ASSUMPTION OF RISK: I fully understand and acknowledge that:
       (a)   There are risks and dangers associated with My/My Childs' Participation that can result in serious, permanent or fatal injuries.
       (b)   The social and economic losses and/or damages, which could result from these risks and dangers described above could be severe.
        (c)   These risks and dangers may be caused by my/my child's action, in action or negligence or by the action, inaction or negligence of others, including, but not limited to, the Released Parties.
        (d)   There may be other risks and dangers that are not known to me/my child or are not foreseeable at this time.
        (e)   I accept and assume any and all risks and dangers associated with My/My Childs' Participation. I agree that I am solely responsible for any injuries or damages of any kind arising out of or relating to My/My Childs' Participation, even if the injuries or damages are the result of the negligence or other improper conduct of any of the Released Parties or others.
4.     MEDICAL TREATMENT: In recognition of the fact that there are risks of serious, permanent or fatal injuries associated with My/My Childs' Participation, I release and forever discharge the Released Parties from any claim whatsoever arising out of or relating to any first-aid treatment or other medical services rendered in connection with any injuries or emergency during My/My Childs' Participation.  Pre-existing medical conditions must be accepted by ECS Management prior to training.  This may include permission from a licensed medical professional. 
5.     PHOTOGRAPHIC RELEASE: I grant and convey to Elite Combative Systems, LLC, all right, title, and interest in any and all photographs, images, video, and audio produced during or in connection with My Participation.
6.     OTHER: I expressly agree that this Release is intended to be as broad and inclusive as permitted by the laws of the Commonwealth of Pennsylvania and that this Release shall be governed by and interpreted in accordance with the laws of the Commonwealth of Pennsylvania except its conflict-of-law principles. I agree that in the event that any part of this Release is deemed invalid, the other parts of this Release shall remain enforceable.  ALL CONVICTED FELLONS MUST GAIN MANAGEMENT APPROVAL TO TRAIN.
I HAVE READ THIS RELEASE. I FULLY UNDERSTAND ITS TERMS AND THAT I AM GIVING UP SUBSTANTIAL RIGHTS BY SIGNING IT. I AM SIGNING IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT, ASSURANCE, OR GUARANTEE BEING MADE TO ME.
